Are Incoterms\u00ae Superior to National or EU Law? Do They Override Domestic Law?<\/strong><\/h2>\n\n\n\n

Short and clear:<\/strong> Incoterms\u00ae are not statutory law\u2014neither superior to national law nor to EU law. Consequently, they do not override (\u201cbreak\u201d) domestic or EU legislation. Incoterms\u00ae apply only if they are expressly incorporated into the contract and must always be interpreted within the framework of the applicable legal system.<\/p>\n\n\n\n

1. Incoterms\u00ae as Contractual Rules (Not Law)<\/strong><\/h2>\n\n\n\n

Incoterms\u00ae are standard trade rules issued by the International Chamber of Commerce (ICC). They are not legislation and have no automatic legal effect.
